Terms and Conditions

GENERAL TERMS AND CONDITIONS FOR THE RESERVATIONS

Thank you for your reservation! Please observe the following General Terms and Conditions for the reservations. When making a reservation, the Client confirms having read and accepted this General Terms and Conditions for the reservations.
In this way, all the provisions stipulated in these Terms and Conditions become legally binding on both the Client and the Imperial d.d.. When making a reservation, the Client is obliged to provide all required data.

HOTELS / TOURIST SETTLEMENTS / APARTMENTS

To reserve the accommodation at the hotels, tourist settlement and apartments, it is necessary to pay 30% of the total amount in advance. The rest is payable at the accommodation reception during the Client stays in the facilities of the Imperial d.d. or latest on the check-out day.
In case of cancellation of 7 days before the arrival the advance payment will be returned.
In case of cancellation 7-0 days before the arrival the advance payment is non-refundable.

In case of cancellation, the date of receipt of the written cancellation shall be the basis for the calculation of cancellation costs as follows:

• for a cancellation from 7 to 0 before the start of use of the service, a charge of 100% of the accommodation price shall be made;
• where the Client cancels the reservation due to force majeure, the Client is required to produce written confirmation of the force majeure, and the Imperial d.d. shall only charge the actual costs of cancellation, which shall be no more than 25% of the total value of the service.

If the Client does not enter the reserved accommodation unit until midnight on the day of the start of use of the service, without notifying Imperial d.d. or the provider of the service, the reservation shall be deemed cancelled, and the cancellation costs will be charged according to the above-mentioned rates. If the actual costs of cancellation exceed the above- mentioned rates, the Imperial d.d. reserves the right to charge actual costs.

If the Client who cancels the reservation finds a new user for the same reservation, the Imperial d.d. will only charge actual costs caused by this change.

Where the Client wants to change or cancel a reservation made at his or her request, this must be done in writing by sending an e-mail to: reservations@imperial.hr . If the reservation change is available the Imperial d.d. will confirm it and regarding the new reservation the new

terms and conditions will be issued. Should a change of reservation not be possible, and should the Client decide to cancel the confirmed reservation on account of that, or should the Client decide to cancel the confirmed reservation on the account of the other reasons, then the below-mentioned cancellation terms shall apply.

 

VILLAS

 

To reserve the accommodation at villas, it is necessary to pay 30% of the total amount in advance. The rest is payable 30 days before the Client starts using the services in the facilities.
In case of cancellation of 45 days before the arrival the advance payment will be returned.
In case of cancellation 44 days before the arrival the advance payment is non-refundable.

To ensure in case of equipment damage deposit of 200 Euro is payable on the arrival.

The amount of the deposit will be returned at the end of the stay if there are no damages at the Villa equipment.

If the Client does not enter the reserved accommodation unit until midnight on the day of the start of use of the service, without notifying Imperial d.d. or the provider of the service, the reservation shall be deemed cancelled, and the cancellation costs will be charged according to the above-mentioned rates. If the actual costs of cancellation exceed the above- mentioned rates, the Imperial d.d. reserves the right to charge actual costs.

If the Client who cancels the reservation finds a new user for the same reservation, the Imperial d.d. will only charge actual costs caused by this change.

Where the Client wants to change or cancel a reservation made at his or her request, this must be done in writing by sending an e-mail to: reservations@imperial.hr . If the reservation change is available the Imperial d.d. will confirm it and regarding the new reservation the new

terms and conditions will be issued. Should a change of reservation not be possible, and should the Client decide to cancel the confirmed reservation on account of that, or should the Client decide to cancel the confirmed reservation on the account of the other reasons, then the below-mentioned cancellation terms shall apply.

 

CAMPSITES

CAMPING PITCH

For campsites, a one-off camping pitch reservation fee, the amount of 30 Euro is payable on booking.
The reservation fee for the pitches booked in the period between the 28th of July and the 6th of September is non-refundable.
The reservation fee for the pitches booked until the 28th of July and from the 6th of September will be included at the total price of the stay.
The amount of the final invoice is payable at the reception of the campsite until the 1.00 pm for the departures on that same day, or until the 3.00 pm for the departure the next day. In case of the earlier departure, for the days that were reserved and not used the client will be charged a price stated for the empty camping pitch. Campsite reservations apply only to zones. The reservation of the particular number of the camping pitch is subject of a Client wish that can not be guaranteed.

MOBILE HOMES

Mobile homes: for the reservation of mobile homes in campsites it is advance payment of 150
Euro required. The rest is payable 21 day before the Client starts using the services in the facilities
at the mobile home.
In case of cancellation of 30 days before the arrival the advance payment will be returned.
In case of cancellation 29 days before the arrival the advance payment is non-refundable.

In case of cancellation, the date of receipt of the written cancellation shall be the basis for the calculation of cancellation costs as follows:

• for a cancellation by 21-15 days before the start of use of the service, a charge of 40% of the accommodation price shall be made
• for a cancellation from 14 to 8 days before the start of use of the service, a charge of 80% of the accommodation price shall be made;
• for a cancellation from 7 to 0 before the start of use of the service, a charge of 100% of the accommodation price shall be made;
• where the Client cancels the reservation due to force majeure, the Client is required to produce written confirmation of the force majeure, and the Imperial d.d. shall only charge the actual costs of cancellation, which shall be no more than 25% of the total value of the service.

PAYING BY CREDIT CARD

When paying by credit card, the card will be charged for the amount in Kuna (HRK). The online booking system available on the website accepts the following credit cards: American Express, MasterCard, Visa and Diners Club.

CHECK IN at the accommodation facility after 2 p.m. on the day of arrival.
CHECK IN at the camping pitch after 2 p.m. on the day of arrival.
CHECK IN at the mobile home and villa after 4 p.m. on the day of arrival.

CHECK OUT of the accommodation facility by 10 a.m. on the day of departure
CHECK OUT of the camping pitch by 02 p.m. on the day of departure
CHECK OUT of the mobile home by 10 a.m. on the day of departure

SOJOURN TAX

According to the Croatian Sojourn Tax Act, the Client is obliged to pay sojourn tax when paying for the accommodation service. Pursuant to the Croatian Sojourn Tax Act, sojourn tax can amount to between 5.50 HRK and 7.00 HRK per adult per day. Children between 12 and 18 years of age pay 50% of that amount, and children under the age of 12 do not pay sojourn tax. The final amount of the sojourn tax is charged according to these General Terms and Conditions for the reservations at the same time with the payment of the final amount for accommodation services.

REMARK

When making the advance payment, the Client confirms having read and accepted this General Terms and Conditions for the reservations.

DUTIES OF THE IMPERIAL d.d. RAB

SERVICES

The Imperial d.d. provides accommodation services with reference to the published information, description and for the appointed date in accordance with the offer that was sent to the Client or the reservation that was confirmed, except in the case of exceptional circumstances (war, turmoil, strike, terrorist action, sanitary problems, natural disasters, government intervention, death or illness of the service provider etc.).

ACCOMMODATION PRICE

The accommodation price includes the service as described in the offer on the authorised part of the website. Special services are those that are not included in the offer (in the description of the accommodation indicated by the phrase "on request" or additional services on prior agreement) and are payable separately. These services must be requested when making the reservation. Accommodation prices are in Euro. The services are charged in Kuna at the midpoint exchange rate of the HNB ( Croatian National Bank).

Payment of the services can be made: cash in Euro or Kuna or credit cards. The Imperial d.d. reserves the right to change the prices with regard to possible changes in the exchange rate. Where the Guest has paid the advance for a particular reservation, Imperial d.d. guarantees the accommodation price indicated in the offer which was the basis for advance payment. Where more people come to an accommodation unit than stated on the reservation confirmation, the Imperial d.d. reserves the right to refuse service to any person not included in the reservation, or to accept such persons at an additional charge which is payable immediately.

CATEGORISATION AND DESCRIPTION OF SERVICES

Offered accommodation units are described according to the official categorisation of a competent institution, and on the basis of an inspection of the actual state of the accommodation at the moment of publishing. Standards of accommodation, catering, services etc. can vary in different places and countries and cannot be compared. Information given to the Client at the point of sale are not binding on the Imperial d.d. to a greater extent than the information published on the website www.imperial.hr and www.rab-camping.com or in the catalogue and other printed materials published by the Imperial d.d..

RIGHT OF THE IMPERIAL d.d. RAB ON CHANGES OF THE RESERVATION AND CANCELLATION

The Imperial d.d. reserves the right to change a reservation in case of extraordinary circumstances that cannot be predicted, avoided or resolved. Reserved accommodation can be replaced only after prior notification of the Client and only with an accommodation unit of the same or higher category and for the same price that was confirmed by the Client when making the reservation.

DUTIES OF THE GUEST

The Client is obliged to:
• have valid travel documents;
• respect customs and currency regulations;
• obey house rules in accommodation properties and cooperate with the provider of services in good faith;
• upon arrival at the destination, show a document confirming the payment of the service to the service provider (confirmation of the reservation);
• check whether a visa is required to enter the country of destination or any neighbouring countries;
Should the Client fail to observe these duties, he or she will bear the costs and be liable for damages. With the confirmation of the reservation, the Client agrees that he or she will immediately compensate the provider of the service for any damage done.

LUGGAGE

The Imperial d.d. is not responsible for damaged, destroyed or lost luggage, or in the case where luggage or valuables are stolen from the accommodation facility (it is recommended to rent a safe where such a possibility exists). Lost luggage or theft must be reported to the reception of the accommodation facility and to the competent police station.

COMPLAINTS

If a service from the offer is not satisfactory, the Client can request proportional compensation by filing a written complaint. Every Client has the right to complain about a failure to provide a paid for service. Every Client who has a confirmed reservation shall file a separate complaint.

Complaint procedure: On the day of arrival, the Client shall lodge a complaint about the inappropriate service without delay at the reception, or inform the Customer service department of the Imperial d.d. by sending an e-mail to: customer.service@imperial.hr

The Client shall cooperate with the personnel of the accommodation unit in good faith to resolve the cause of the complaint. Should the Client refuse the offered solution that corresponds to the paid service, the Imperial d.d. shall not be obliged to process any further complaints.

If the Client is not satisfied after the intervention of the personnel, he or she must within 28 days upon return from vacation send a written complaint together with necessary documentation and photographs that prove the justification of the complaint either by e-mail to customer.service@imperial.hr or by post to Imperial d.d., J. Barakovića 2, 51280 Rab, CROATIA.

The Imperial d.d. shall take into consideration only fully documented complaints received within 28 days.

The Imperial d.d. shall issue a written decision on the complaint within 14 days of its reception. The Imperial d.d. can postpone the deadline for the decision on the complaint, for a maximum of 14 days, in order to collect necessary information and to verify the complaint with the provider of the service. The Imperial d.d. will only deal with complaints whose cause could not be eliminated in the tourist resort. Until the Imperial d.d. issues a decision, the Client renounces the mediation of any other person, or arbitral or court institution, and shall not provide information to the media.

The maximum compensation for a complaint shall be an amount equivalent to that part of the service that was complained about, and shall not include used services or the total amount of the service.

JURISDICTION
If the Client is not satisfied with the solution to his or her complaint, he or she has the right to judicial arbitration. In such cases, the court of jurisdiction is the court in Rijeka.

PRIVACY POLICY

DECLARATION OF SECURITY

Pay Way applies the latest standards in data protection – the Secure Socket Layer (SSL) protocol with 128-bit data encryption and the MD5 algorithm. The ISO 8583 protocol ensures that the exchange of data between T-Com internet and authorisation centres in credit card companies takes place within a private network, which is protected from unauthorised access by a double firewall.
For MasterCard and Visa cards, the 3D Secure protocol for safe payment is applied.

DECLARATION ON PRIVACY AND COLLECTING PERSONAL DATA AND THEIR USE

The Imperial d.d. Rab is committed to protecting the privacy of all its clients. All user data are kept strictly confidential and only available to employees who need these data for their work. All the employees of the Imperial d.d. Rab and its business partners are responsible for respecting privacy.

Despite the fact that we use the best security technology, we cannot take responsibility for any malicious contents, spyware or viruses that circulate on the internet. Users of this website are required to obtain and install their own anti-virus software to protect themselves from malicious contents or data loss.

The user of this website agrees that the Imperial d.d. Rab is not liable for errors in data transfer, interruptions or delays in telephone traffic, data network, interruptions or inability to access the internet, or any electrical, electronic or computer problems of any kind.

The Imperial d.d. Rab website is public and available to everyone, and the service is provided on the basis of availability. We disclaim any responsibility for any direct, indirect, accidental, special or commercial damages, including loss of profit, which may arise from the ability or inability to use this website.

The Imperial d.d. Rab reserves the right to change any information in this document. Any changes made will be immediately available to the users of this website.
